Changes to Information Returned in Reports

Beginning December 10, 2018, IntelliCorp will be making some changes to what is returned in reports.  First, reports will no longer include stand-alone dismissals. What does this mean?

Here are some examples:

Example 1:

A consumer has one charge, but the charge was dismissed.

We will not return the dismissal.

Example 2:

A consumer has two charges, but only one charge was dismissed.

We will return both charges.

Example 3:

A consumer has two charges, but both were dismissed.

We will not return the charges.

Why we are making this change:

  • Some states (such as, but not limited to, California and Illinois) prohibit taking any action against a consumer based on a dismissed record.
  • There are many reasons a court may choose not to pursue the charge(s) against a consumer, hence the charge(s) being dismissed.
  • Courts dismiss records for a variety of reasons (and the reasoning behind doing so is unknown).
  • To be more in line with the Equal Employment Opportunity Commission’s (EEOC) guidance, whereby arrests/charges are not proof of criminal conduct, and many arrests do not result in criminal charges, or the charges are dismissed.

Second, no records tied to offenses when an individual was a juvenile will be returned unless it is clearly marked in the case that the individual was tried as an adult.

By making this update to our reports, the information we return will be more meaningful and helpful as you make important decisions regarding your applicants and volunteers.
