Connecticut Governor Signs 'Ban the Box' Law

Governor Dannel Malloy of Connecticut recently signed “An Act Concerning Fair Chance Employment”, instituting a ‘ban the box’ mandate for employers in that state. With this new law Connecticut has joined a growing list of states who have some form of ‘ban the box’ in place.

Beginning on January 1, 2017, employers will not be allowed to ask criminal history questions prior to the first interview being conducted. Employers must eliminate all inquiries regarding an applicant’s prior arrests or convictions from their applications.

With many states enacting ‘ban the box’ legislation, and many more considering their versions of it, all employers should begin now to review their hiring procedures and strongly consider changing when and how criminal history questions are asked of applicants. This even includes companies residing in states without a ‘ban the box’ law on the books. It may be a good practice to get ahead of the curve and prepare for the inevitable change.
