U.S. Government Considering A Federal Version Of Ban The Box Legislation

The Fair Chance Act (S.B. 842 & H.B. 1905) has been introduced in the US Congress as a federal equivalent of various ‘ban the box’ laws around the country. This proposed law would mandate government agencies and contractors to delay a criminal background check until after a conditional job offer has been made. The Fair Chance Act also has a related piece of legislation entitled the Record Expungement Designed to Enhance Employment Act, which would seal certain criminal records. 

With statistics showing as many as 70 million U.S. adults having arrest or conviction records, ‘ban the box’ legislation like the Fair Chance Act have grown very popular among lawmakers and have gained appeal with voters.
