Nursing Home Company Faces Federal Lawsuit Over Use of Background Checks

A federal lawsuit was filed recently alleging that Genesis Healthcare, one of the largest nursing home chains in the U.S., violated the FCRA when denying employment to an individual based on a background check.

According to Doris Ramos, not only did Genesis Healthcare not provide her with a copy of the background check or a statement of her rights. She also claims that the information contained in the background check was inaccurate and Genesis never gave her an opportunity to correct the record. 

These alleged actions highlight for all employers the need to maintain a comprehensive and compliant background screening program that takes into account all the necessary steps outlined by the FCRA. Some of these steps include obtaining authorization for a background check, notifying the applicant of their rights during the process, and providing an adverse action letter letting the applicant know the results of the background screen, thereby providing them an opportunity to correct the record.
